    • Collaboration Café Web services” refers to the Web-based software-driven facilities provided on the collaboration.cafe domain and its subdomains.
    • Professional assistance services” refers to any commercially-billed assistance services provided by a legally-registered commercial entity such as a self-employed freelance contractor or a company.
    • Pro bono assistance services” refers to any free-of-charge non-commercial assistance services provided under the status of a private individual.
    • Service receiver” refers to any person or entity being provided with a Collaboration Café Web service or a professional or pro bono assistance service.

Acceptance of terms

By accessing and using Collaboration Café websites/services, you accept and agree to be bound by the conditions explained in this Legal Information page.

Provision of Web services

The Collaboration Café domain (collaboration.cafe) and its subdomains provide a variety of collaborative and non-collaborative Web services. All features of these Web services are under your control and require your explicit permission or tacit acceptance.

The availability of these Web services is on a best-efforts basis only, and they may be unavailable, withdrawn or modified at any time, without notice, depending on circumstances or necessities.

No claim concerning compensation or liability will be accepted in the event of a service unavailability or failure, including a security breach.

Registration and user accounts

Certain Collaboration Café Web services may not necessarily require you to have a registered user account to avail the said services, but you are nonetheless required to accept and comply with the conditions of this Legal Information page. 

User accounts for all Collaboration Café Web services are registered manually and individually by the site operator after communication with a prospective service receiver and approval of a service request. Account credentials will forwarded by email.

Registration of an account is considered to be a pro bono assistance service provided to you, the service receiver, by the site operator.

If you are granted and accept an account, you accept the provision of the rendered services, and you undertake to comply with the conditions of this Legal Information page, and with the terms and recommendations of the Privacy page (privacy, safety and GDPR information).

User accounts are granted for personal use only, and may not be used for providing services to third parties without the site operator’s prior agreement. If you want to provide services to third parties, please consult the ‘Provision of professional and pro bono assistance services‘ section and message the site operator via the contact form.

All users are required to comply with the Code of personal conduct.

Collaboration Café Web services implement full GDPR compliance and have a self-service account deletion feature. Please read the Privacy page for more information.

Collaboration café email service is compliant with GDPR but an email account can only be deleted manually by the site operator, who will do that for you whenever you request.

Access to a user account may be suspended if you violate the Code of personal conduct or other conditions in this Legal Information page.

The site operator will attempt to contact you by email, to allow conflict resolution. If conflict resolution fails, your account may be deleted after giving you fair opportunity to recover your data.

Age limit

Account registration is only allowed for persons aged at least 18.

Intellectual property and ownership

All content shared via Collaboration Café services remains the property of the original owner, and there is no transfer or acquisition of ownership due to sharing or other revelation.

A change of ownership or acquisition of rights can only take place in a properly documented and properly conducted commercial transaction that previously has been explicitly approved by the site operator and explicitly accepted by the original owner of the rights. 

Indemnification

You agree to indemnify and hold harmless the site operator of Collaboration Café Web services from any claim arising from your violation of these terms.

Code of personal conduct

When using Collaboration Café Web services, you agree to comply with the following code of personal conduct:

    • No content or links showing sadism, masochism or other forms of violence, with the intent of entertaining, shocking or disgusting.
    • No hateful, harmful, threatening or aggressive content or communication with the intent of shocking, disgusting or intimidating.
    • No harassment; no “trolling”; no bullying.
    • No content or communication that could be qualified as defamation, slander or libel.
    • No racism; no promotion of bigotry, eugenics or racial/ethnic segregation; no promotion of racial, religious or ethnic intolerance.
    • No homophobic, biphobic, transphobic or sexist communication or content.
    • No ableism; no disparagement of the physical appearance, abilities, intelligence or other attributes of another person or population.
    • No use of language that could be considered to be offensive to people of a particular ethnicity, religion, gender, sexuality or other population.
    • No ad hominem attacks; no insults or derogatory attacks against a person because of their race, creed, color, beliefs, sexual orientation, gender identification or other motivations.
    • No revelation of private personal information or content about other persons (no “doxing”).
    • No revelation of confidential or protected information of companies or other organizations that is not already in the public domain and considered to be public knowledge.
    • No activity, communication or content designed to harvest personal information for illicit purposes (no “phishing”).
    • No “grooming” behavior; no “stalking” behavior.
    • No gambling; no betting; no wagering; no promotion of gambling or gambling sites; no rooms, groups or communications about games or activities involving or giving rise to gambling or monetary payments in any form or for whatever service or commodity.
    • No communication about or conducting of any kind of investment, loan or bartering schemes or business dealings; no conducting of any commercial business without prior explicit permission from the site operator.
    • No commercial advertising; no “infomercials”; no “commercials”; no “spam” or advertising links; no promotion of commercial businesses without prior explicit written consent from the site operator.
    • No preying or profiteering or exploitative behavior, particularly against anyone that could be construed as vulnerable, disadvantaged, susceptible or impressionable.
    • No using any service accessed on or via this site for cultivation of a relationship or communication for any illegal or harmful purpose.
    • No proselytizing; no content or communication pressurizing people to join a particular religion, cult or political organization; no content or communication encouraging or requesting monetary donations or other contributions to a religious, social or political organization, cult or movement.
    • No promotion of political violence or terrorism.
    • No promotion of dangerous, excessive and/or illegal use of alcohol or drugs.
    • No promotion of self-harm or suicide; no content that encourages, causes or perpetuates a psychological or emotional state of mind that could give rise to self-harm or suicide.
    • No activity intended to disrupt or exploit the operation of any service on this site or on other sites; no “cracking”; no participation in Dynamic Denial Of Service (DDOS) attacks, cross-site scripting attacks or other forms of illicit exploit against this site, or via this site and against any other site or service.
    • No copyright or intellectual property infringements; no re-posting of content of another person, website or organization, from which they derive revenue or for which they legitimately claim publishing exclusivity, without explicit written consent from the rights holder.
    • No disinformation or misinformation; no publication of content or communication that might be considered to be social or political disinformation or misinformation, according to the arbitrary judgment of the site operator; no publication or recommendation of hyperlinks or other means of access to such content or media.

Provision of professional and pro bono assistance services

If you are granted a user account, it is deemed to be for personal use only, and you may not provide any professional or pro bono assistance services to any party via Collaboration Cafe Web services without explicit prior written agreement of the site operator.

You can request approval from the site operator via the contact form to provide professional and/or pro bono assistance services to other parties.

Approval will be subject to signature of a collaboration agreement with the site operator, and subject to your agreement to be identified by name and with certain contact information in the Imprint page, in compliance with all legislation applicable to your registration and the site operator’s registration as a business entity.

All professional and pro bono assistance services must be in compliance with the Code of professional conduct.

The usage and operation of Collaboration Café Web services are subject to all applicable legislation in Germany.

Paid professional assistance services will be presumed to be under the jurisdiction of all applicable legislation in the country in which the service provider is legally registered for commercial operation and fiscal accounting.

Non-commercial pro bono assistance services will be presumed to be under the jurisdiction of all applicable civil law legislation in the country or countries of residence and of nationality of the service provider and the service receiver.

In the event of a contradiction or difference in the various national or international legislations applicable to any service, the most-constraining clauses will be applied.

Microsoft Windows“, “Microsoft 365“, “Microsoft Office” and any other Microsoft products mentioned in any Collaboration Café Web services and pages are product/service names copyrighted and owned by Microsoft Corporation.

All other products and services mentioned in any Collaboration Café Web services and pages are the property of their respective owners.

All content written by the site operator on this Collaboration Cafe service information website and other Collaboration Café Web services is copyrighted by the site operator. 

Affiliation information

Collaboration Café Web services and the site operator do not have any affiliation with Microsoft Corporation, nor with any of the other third-party services and products mentioned in Collaboration Café Web services and pages.
